They only THINK they didn't see/hear a disclaimer

I'm sure you know of all of the disclaimers that appear at the bottom of an advertisement like 'not available to UK residents' or 'all calls $0.30 a second'

The the smart or lucky people notice these things and totally avoid the product.

Why not have these messages subliminal and avoid people making the higher-level decisions of avoiding the product because of this?
